Welcome to Trim Capital Partners LLC ("Trim Capital," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our subscription-based services, including the Pulse Package, Market Maverick Package, and Elite Package (collectively, the "Services"). By subscribing to or using any of the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

 

1. Description of Services

Trim Capital offers three subscription packages, each providing access to specific features and content related to cryptocurrency and financial markets. The details of each package are as follows:

 

1.1 Pulse Package

For a monthly fee of $9.99 (USD), the Pulse Package provides:

• Access to all free weekly cryptocurrency reports.

• Access to blog posts and select cryptocurrency charts from the Trim Capital Partners LLC Supersystem ("TCP Supersystem").

• Access to our Monthly Crypto Report, including details of any executed trades by Trim Capital Partners LLC.

• Access to our monthly newsletter, highlighting key cryptocurrency news, partnerships, and legislative updates.

1.2 Market Maverick Package

For a monthly fee of $49.99 (USD), the Market Maverick Package includes all benefits of the Pulse Package, plus:

• Access to all TCP Supersystem Alerts through the TCP Supersystem Alerts Page.

• Access to weekly Zoom calls to discuss cryptocurrency and equity charts and alerts from the TCP Supersystem.

• Access to blog posts dedicated to Level 2 and Level 3 Alerts from the TCP Supersystem.

• Access to select Trim Capital Partners LLC trades and rationalization insights via blog posts.

 

1.3 Elite Package

For a monthly fee of $89.99 (USD), the Elite Package includes all benefits of the Pulse and Market Maverick Packages, plus:

• One-on-one Zoom calls to discuss the TCP Supersystem.

Free Bonus: Access to the TCP Supersystem in TradingView, which is invite-only.

 

2. Subscription Terms

 

2.1 Subscription Eligibility

• You must be at least 19 years old to subscribe to any of the Services.

• Subscriptions are limited to one (1) per customer per package type (e.g., one Pulse Package, one Market Maverick Package, or one Elite Package per customer).

• You agree to provide accurate, current, and complete information during the subscription process and to update such information to keep it accurate.

 

2.2 Trial Periods

• Pulse Package: Includes a 45-day trial period starting from the date selected by you at checkout. During the trial period, you will have full access to the Pulse Package at no charge.

• Market Maverick Package and Elite Package: Each includes a 30-day trial period starting from the date selected by you at checkout. During the trial period, you will have full access to the respective package at no charge.

You may cancel your subscription at any time during the trial period without incurring any fees. If you do not cancel before the end of the trial period, your subscription will automatically convert to a paid, recurring monthly subscription as outlined in Section

2.3 Subscription Fees and Billing

• Pulse Package: After the 45-day trial period, you will be charged $9.99 per month (plus applicable taxes).

• Market Maverick Package: After the 30-day trial period, you will be charged $49.99 per month (plus applicable taxes).

• Elite Package: After the 30-day trial period, you will be charged $89.99 per month (plus applicable taxes).

 

Subscription fees are recurring and will be automatically billed to the payment method provided at checkout on a monthly basis until canceled.  All fees are non-refundable, except as required by applicable law or as otherwise specified in these Terms.

 

2.4 Start Date

You may select the start date for your subscription at checkout. The applicable trial period and subsequent billing cycles will commence on the selected start date.

 

2.5 Cancellation

You may cancel your subscription at any time through the "My Subscriptions" page on our website.  Cancellation will take effect at the end of the current billing cycle, and you will retain access to the Service until the end of that cycle.  No refunds or credits will be issued for partial billing periods or unused portions of the Services.

 

2.6 Payment Processing

Payments are processed through a third-party payment processor. By providing your payment information, you authorize us to charge the applicable subscription fees to your chosen payment method.

 

You are responsible for ensuring that your payment information is accurate and up-to-date. If a payment is declined, we may suspend or terminate your access to the Services until payment is successfully processed.

 

3. Use of the Services

3.1 License

Subject to your compliance with these Terms, Trim Capital grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes.

 

3.2 Restrictions

You agree not to:

• Share, distribute, or reproduce any content from the Services, including reports, charts, blog posts, newsletters, alerts, or TradingView access, without prior written consent from Trim Capital.

• Use the Services for any unlawful purpose or in violation of these Terms.

• Attempt to reverse-engineer, decompile, or otherwise extract proprietary information from the Services, including the TCP Supersystem or TradingView integration.

• Use the Services to engage in any activity that could harm Trim Capital or its affiliates, subscribers, or partners.

 

3.3 Financial Information Disclaimer

The Services provide information related to cryptocurrencies, equities, and markets, including reports, charts, alerts, and newsletters. This information is for informational purposes only and does not constitute financial, investment, or legal advice.

• You acknowledge that cryptocurrency and equity investments carry significant risks, and you are solely responsible for any decisions made based on the information provided through the Services.

• Trim Capital does not guarantee the accuracy, completeness, or timeliness of the information provided and is not liable for any losses or damages arising from your use of the Services.

• The inclusion of executed trades or rationalization insights in the Services does not constitute a recommendation to buy, sell, or hold any asset.

 

 

4. Intellectual Property

All content provided through the Services, including but not limited to reports, charts, blog posts, newsletters, alerts, and the TCP Supersystem (including its integration with TradingView), is the property of Trim Capital or its licensors and is protected by copyright, trademark, and other intellectual property laws.

• You may not reproduce, modify, distribute, or create derivative works from any content provided through the Services without prior written permission from Trim Capital.

• Access to the TCP Supersystem in TradingView is provided as a free bonus for Elite Package subscribers and is subject to the same restrictions. Unauthorized sharing or distribution of this access will result in immediate termination of your subscription.

 

5. Zoom Calls

Weekly Zoom Calls (Market Maverick and Elite Packages): Access to weekly Zoom calls is subject to availability and scheduling by Trim Capital. We reserve the right to modify the frequency, format, or content of these calls at our discretion.

One-on-One Zoom Calls (Elite Package): One-on-one Zoom calls are subject to scheduling availability and must be booked in advance. Trim Capital reserves the right to limit the frequency or duration of these calls to ensure equitable access for all Elite Package subscribers.

You agree to use Zoom calls in a manner consistent with these Terms and not to record, reproduce, or share the content of these calls without prior written consent from Trim Capital.

6. Termination

We reserve the right to suspend or terminate your access to the Services at our sole discretion, with or without notice, for any reason, including but not limited to violation of these Terms, non-payment, or suspected fraudulent activity.

Upon termination, your access to the Services, including TradingView access for Elite Package subscribers, will cease, and any outstanding fees owed will remain due.

7. Modifications to the Services and Terms

Trim Capital reserves the right to modify, suspend, or discontinue the Services (or any part thereof) at any time, with or without notice.

 

We may update these Terms from time to time. The updated Terms will be posted on our website with the revised effective date. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms.

 

8. Limitation of Liability

To the fullest extent permitted by law, Trim Capital, its members, affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with your use of the Services.

 

Our total liability to you for any claim arising from these Terms or the Services will not exceed the amount paid by you for the applicable Service in the six (6) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Trim Capital and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Services, violation of these Terms, or infringement of any third-party rights.

 

10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law principles.

 

Any disputes arising from these Terms or the Services will be resolved through binding arbitration in Birmingham, AL, in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.

11. Privacy

Your use of the Services is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information. The Privacy Policy is available on our website and is incorporated into these Terms by reference.

12. Third-Party Platforms

General Third-Party Services: The Services may rely on other third-party providers for functionality, including payment processing or content delivery. Trim Capital is not liable for any disruptions, errors, or issues caused by such third-party providers. You acknowledge that access to the Services may be affected by the performance or availability of these third-party platforms.

 

TradingView Access (Elite Package): Access to the TCP Supersystem in TradingView is provided through a third-party platform. You agree to comply with TradingView’s terms of service and any applicable third-party policies. Trim Capital is not responsible for any issues arising from your use of TradingView or any third-party platform.

 

Zoom Calls: Zoom calls are facilitated through a third-party platform (Zoom). You agree to comply with Zoom’s terms of service and any applicable third-party policies. Trim Capital is not responsible for any technical issues or interruptions related to the Zoom platform.

Website Hosting (Wix): Our website and certain aspects of the Services are hosted by Wix.com or its affiliates ("Wix"). You acknowledge that Trim Capital Partners LLC is not responsible for any interruptions, downtime, or other issues arising from Wix’s hosting services, including but not limited to website inaccessibility, data loss, or service disruptions. Your use of our website is subject to Wix’s terms of service and policies, which you agree to comply with.

 

13. Miscellaneous

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Trim Capital regarding the Services.

 

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

 

No Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

 

Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms at our discretion.
